" First of all, it appears that the judges hearing the orals (after already digesting all the legal briefs,) meet IMMediately afterwards and DECIDE THE CASE then and there. That always made a lot of SENSE to me since it is very logical to see that cases can get "cold" in a hurry, especially when you have the SAME kind of legal stuff going on day after day, month after month. And EVERYbody wants THEIR decision to be wrapped up as clean and neat as possible. That was 6 long months ago. Now, these folks are supposed to be consummate PROfessionals and for God's sake, they ought to know the law!! In reality, this ought to be a cut and dried case. From every point-of-view. WHAT reasonable "sticking point" has AAPL ever produced?? NObody here, even our own expert legal beagles, has ever poked a hole in VHC's overwhelming legal case. The "appeal" may look "complicated" to many of us but the reality is that this is bread and butter IP CAFC decision making. And the DElay is even worse if you are on the side that has shot down all of AAPL's arguments and note the famous "citation" is already on the books. It took me about 10 minutes to dictate the most complicated head and neck cancer/reconstructive surgery that I ever performed. And these folks get GREATER than 6 months?? I would have lost my hospital privileges and been reported to the Medical Board long before 6 months if my report was tardy. This delay is Bullsh*t and only serves to allow the shorts to stack the deck against us more and more each day. Like, how about another 100,000 air share day like today?? BRING IT ON!! Good or bad. For better or worse. Hell, Ming and I will both be in wheelchairs and Depends by the time we can get together to discuss the outcome. Chip$ter |
